1. GENERAL INFORMATION AND SCOPE
1.1 Westwing operates an online store on the www.westwing.cz Website.
1.2. Orders may be placed and the offers of the Online Shop may be used by individuals of legal age who have full legal capacity, acting as consumers. To complete the order, the customer must choose the payment method and delivery method, as well as information enabling the processing of the order, including certain personal data, i.e. in particular name and surname, address, contact persons, e-mail address, telephone, as well as agree to the provisions of these Terms and Conditions, the provisions of the Privacy Policy and give the consents necessary to use the online store.
1.3 In principle, goods are sold only in customary household quantities.

2.5 In your customer account, you can view and, if necessary, change your open, recently dispatched and/or completed orders, as well as clearly manage and store your own data, vouchers, newsletters and notifications.
2.6 You may register on the www.westwing.cz Website with only one customer account and use only one customer account at a time. If Westwing detects multiple registrations, it may delete them.
2.7 It is prohibited to use the Website www.westwing.cz or its content for purposes that are unlawful, abusive or prohibited by law and these T&Cs. In particular, technical processes must not be interfered with or tampered with. In the event of acts or attempts to obtain undue advantages to the detriment of Westwing or other customers, Westwing reserves the right to block the customer's account and not accept offers.
2.8 Westwing reserves the right to issue warnings, refuse orders, restrict the available payment methods, suspend or terminate access to the www.westwing.cz Website or delete transmitted content if the provisions of these GTC are violated or if there is an abuse of rights. Your right of withdrawal in accordance with § 13 of the GTC is not limited by the above measures. Any claims for damages by Westwing remain unaffected.
3. PARTIES, LANGUAGE AND CONCLUSION OF THE CONTRACT
3.1 Westwing is the contracting party for concluding contracts on the www.westwing.cz Website.
3.2 The www.westwing.cz website is operated in the Czech language. Contracts through the website are concluded exclusively in the Czech language.
3.3 An offer of goods on the www.westwing.cz is not a binding offer. The offer must be understood as a non-binding invitation to submit a tender (so-called invitatio ad offerendum). After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, you make a legally binding contractual offer by ordering the goods that are currently in the virtual shopping cart by clicking on the "Ordering" button. 3.5 Order processing and contacting is usually carried out via automated order processing or by e-mail. You must ensure that the email address you provide for order processing is correct so that emails sent by Westwing can be received there. In particular, if you use SPAM filters, you should ensure that all emails sent by Westwing or third parties on behalf of Westwing for the purpose of processing your order can be delivered.
4. SHIPPING PRICES AND COSTS
4.1 For orders of goods on the www.westwing.cz website, the prices stated on the goods details page at the time of order apply. Prices are listed as total, including VAT and handling. Prices are in Czech crowns. Shipping costs will be added later.
4.2 Shipping costs are charged separately for each order and are based on the price shown on the product detail page. This depends, among other things, on the size, weight and the respective mode of transport. This is at the discretion of Westwing.
5. PAYMENT TERMS AND PAYMENTS
5.1 Payment of the full price for the goods ordered by you in one of the ways listed below is a condition of performance by Westwings. You can pay for the goods using one of the following payment methods:
credit/debit cards (VISA, Mastercard, American Express), ApplePay, GooglePay (only available when ordering via a web browser), Blik, Przelewy24 (P24), cash on delivery, prepayment and Klarna.
5.2 Westwing currently accepts various credit cards: VISA and Mastercard and American Express. Upon receipt of your order, Westwing will charge your credit card for the invoiced amount through our payment service provider Stripe Payments Europe Ltd (registered with the Irish Trade and Companies Register under number 3206488LH).
5.3 The payment methods ApplePay, GooglePay, Blik and P24 are processed by the payment service provider Stripe Payments Europe Ltd (registered in the Irish Companies Register under number 32064LH).
5.4 Westwing, in cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden (registered in the Swedish Trade and Companies Register under number 556737-0431), offers you the following payment options if you have an appropriate credit rating: purchase on account with payment within 30 days, payment in three interest-free instalments, financing with interest or payment immediately. 5.5 Westwing is not liable for any loss of payment, payment error or other misconduct or damages that may arise as a result of your actions or those of a third party (e.g. payment service provider).
6. INVOICING
6.1. By accepting the GTC, you agree that Westwing may send invoices to you by electronic means or make them available to you by electronic means in accordance with Article 232 of Council Directive 2006/112/EC.
6.2 Please note that if your data is not correct when ordering according to point 2.2, we can no longer issue a corrective invoice to correct your data after completing the order.
7. VOUCHERS
7.1 Westwing offers different types of vouchers: Gift Vouchers, Promotional Vouchers and Compensation Vouchers.
7.1.1 Gift Vouchers
7.1.1.1 Gift Vouchers are vouchers that can be purchased on the www.westwing.cz website and can only be redeemed for www.westwing.cz, unless otherwise stated on the Gift Voucher. Gift vouchers will be issued to you by e-mail after ordering.
7.1.1.2 Gift vouchers and the remaining amounts of gift vouchers can be redeemed until the end of the third year following the year of purchase of the gift voucher.
7.1.1.3 Westwing may accept a maximum of five Gift Cards per order for technical reasons. If you wish to purchase more than five gift cards, please contact Westwing Customer Service. service@westwing.cz to convert gift cards into a single gift card. The total amount of gift vouchers can also be redeemed in one order.
7.1.1.4 Gift Cards can only be used to purchase goods and not to purchase other Gift Cards.
7.1.1.5 If the price of your order exceeds the credit of the Gift Voucher, you can pay the difference using the payment methods offered. If the price of your order is less than the gift card credit, you can redeem the remaining credit on your next order.
7.1.1.6 In the event of withdrawal from the contract - for whatever reason - the purchase price will be refunded by means of a post-entry to the voucher account and to any other means of payment used.7.1.1.7 The Gift Voucher is transferable.
7.1.1.8 Lost, especially stolen, gift card codes are not returned. Westwing takes no responsibility for lost gift card codes.
7.1.2 Promotional Vouchers (including Refer-a-Friend Vouchers)
7.1.2.1 Promotional vouchers are vouchers issued free of charge as part of advertising campaigns with a certain period of validity and cannot be purchased. Promotional vouchers can only be used for www.westwing.cz during a specified period, but not for postage or set-up fees. Promotional vouchers may be subject to additional, individual conditions. These will be communicated to you directly in connection with the voucher.
7.1.2.2 Vouchers that you have received as a new customer following an invitation from a Westwing member (so-called "refer-a-friend" voucher) cannot be redeemed if you already have an account with Westwing, as the voucher can only be redeemed for new customers.
7.1.2.3 Vouchers for the first registration or for new customers that you receive once per registration on the www.westwing.cz website can only be redeemed once per customer account.
7.1.2.4 Only one Promotional Voucher can be redeemed per order. It is not possible to return or credit the balance of a promotional voucher if the value of the purchase is less than the value of the voucher.
7.1.2.5 A Promotional Voucher is non-transferable, non-refundable and cannot be redeemed again if you return goods that you have paid for in whole or in part with the Voucher on the basis of your statutory right of withdrawal. If you return the ordered goods proportionately, the value of the voucher will be divided proportionally to the ordered goods, i.e. in the case of returning individual items, the voucher will be credited proportionally to the price of the returned goods and expires proportionally to the value of the goods. If the voucher is linked to a minimum order value, it must also be achieved in the case of a partial return, otherwise the voucher value will not be credited.
7.1.3. Compensation vouchers
7.1.3.1 Compensation Vouchers are vouchers that cannot be purchased, but are issued by Westwing at its discretion as compensation without acknowledging any legal obligation.
7.1.3.2 The rules for promotional vouchers shall apply mutatis mutandis.
7.2 Westwing may, in the event of reasonable suspicion of fraud or other activities contrary to the law or the Terms in connection with the purchase or redemption of a voucher, block the relevant voucher code (even temporarily) or refuse to redeem it (even temporarily). In the latter case, you have the right to cancel the order.
7.3 Payment of the voucher amount is not possible, nor is the transfer of value or subsequent settlement of purchases already made, i.e. before the completion of the order process.
7.4 The above vouchers can only be redeemed by consumers.
8. DELIVERY AND SHIPPING CONDITIONS
8.1 Delivery will only take place in the Czech Republic to the delivery address provided by you.
8.2 Basic delivery times will be communicated to you on the relevant goods page.
8.3 The ordered goods will be sent as a package or by a shipping service at Westwing's discretion.
8.4 Westwing shall not be liable for any failure to perform or fail to perform its obligations under this Agreement if this is caused by the occurrence of force majeure, without prejudice to the fact that Westwing will make every effort to limit the consequences of such an event as far as possible.
Force majeure means any unforeseeable event or events which, even if foreseeable, are beyond Westwing's control and the effect of which on the performance of the contract could not have been avoided by Westwing even if it had reasonable efforts. This includes, but is not limited to, war, riot, insurrection, military or civil coup, insurrection, riot, insurrection, embargo, government order, fire, flood, storm, hurricane or other severe weather situation to the extent of the disaster, earthquake, lightning strike, pandemic, epidemic, nuclear hazard or similar cause beyond Westwing's control and which makes it impossible, impossible or commercially impossible to perform or comply with obligations under these GTC Force majeure event occurs, Westwing is obliged to notify you immediately. We will inform you of the additional costs prior to redelivery and will only carry out the delivery with your consent. Please note that the refusal of acceptance is not an effective exercise of your right of withdrawal and must be expressly notified to Westwing. Westwing reserves the right to withdraw from the contract if you do not agree to a new delivery within 7 days. In this case, Westwing will refund any payments already made. 9. WARRANTY, LIABILITY AND DAMAGE IN TRANSIT
9.1 Unless otherwise provided in the following provisions, the statutory provisions on liability for defects shall apply.Westwing accepts no liability for damage caused by incorrect assembly or disassembly, as well as the use of products contrary to the manufacturer's instructions, recommendations or technical requirements. We are not responsible for the customization and compatibility of our goods with other goods, and in situations where:
the product has been further processed by the customer in any way (including any way of using or consuming the goods despite the fact that the defect could be identified before the processing of the goods began or during its processing - before the processing of the entire goods);the customer tampered with the goods, in particular by carrying out any unauthorized repair of the goods without Westwing's consent;
the product defect was caused by improper use or storage contrary to the contents of the instructions and recommendations of the manufacturer of the goods or Westwing and/or contrary to the principles of care or routine maintenance.
The warranty does not apply to mechanical damage to the goods and damage caused by the use of the item. The warranty also does not cover damage caused by placing the goods in an environment unsuitable or harmful to the goods and due to exposure of the goods to natural or human forces contrary to their intended use. Minor deviations from the quality of the color, pattern, design, weight and quantity do not constitute a reason for complaint.

9.2 If the goods are delivered with obvious damage to the packaging or contents, please report this immediately to the relevant delivery company and contact Westwing customer service (service@westwing.cz). Reporting does not affect your warranty rights, but it makes it easier for Westwing to enforce claims against the delivery company.
10. ADDITIONAL WARRANTY
An additional commercial warranty exists only if it is expressly stated and described on the product detail page.
11. CONSUMERS' RIGHT OF WITHDRAWAL
If the purchase contract was concluded by means of distance communication, you can 1829 par. 1 of the Civil Code, withdraw from the purchase contract within 14 days of receipt of the goods. If the subject of the purchase contract is several types of goods or the delivery of several parts, this period runs from the date of receipt of the last delivery of goods.
In the event that your rights have been affected as a result of an unfair practice, you may, in addition to the claims set out in the Civil Code:- withdraw from the contract within 90 days from the date of conclusion of the contract, or- require a reasonable price reduction to the extent appropriate to the nature and seriousness of the unfair commercial practice.

You may withdraw from the Agreement by any other unequivocal declaration made to Westwing.

Withdrawal from the contract by Westwing
Westwing reserves the right to withdraw from the contract if you have ordered goods whose price was clearly disproportionate to the value of these goods (obvious price error). The seller may withdraw from the contract in this way only if this manifestly unreasonable price stated on the e-shop web environment was caused unknowingly.
Westwing is entitled to withdraw from the purchase contract within 14 days from the day following the date of conclusion of the contract, provided that Westwing cancels the order or otherwise indicates to you that it is withdrawing from the contract.

12. CONSEQUENCES OF WITHDRAWAL
The goods must be returned to Westwing undamaged and unworn and, if possible, in their original packaging. Within the 14-day period, you are entitled to view and test the goods. Otherwise, it would be a use of goods. This would reduce its value. You are still entitled to withdraw from the purchase contract, but you are liable to the seller for any reduction in the value of the goods incurred in connection with their handling in a way other than necessary to familiarize you with the nature, properties and functionality of the goods. Westwing is entitled to deduct this reduction in value from the purchase price.
In the event of withdrawal from the contract, Westwing will refund you all the money received, including the cost of delivery, no later than 14 days after the withdrawal from the contract, which it received from you on the basis of the contract, in the same way. We will use the same means of payment for the refund as you used for the original transaction, unless we specifically agree otherwise with you. There will be no refund fee in any case. However, Westwing may withhold such funds until Westwing has received the goods or can prove receipt of the goods by Westwing, whichever occurs first.
However, if the returned goods are damaged, worn or partially consumed, Westwing is entitled to compensation for the damage caused. Westwing is entitled to unilaterally set off this claim against your claim for a refund of the purchase price.
According to the provisions of Section 1837 of Act No. 89/2012 Coll., the Civil Code, the right of the consumer to withdraw from the contract is excluded in the following cases:
provision of services if they were performed with the consumer's prior express consent before the expiry of the withdrawal period and the entrepreneur informed the consumer before concluding the contract that in such a case he does not have the right to withdraw from the contract,
supply of goods or services the price of which depends on financial market fluctuations independently of the will of the trader and which may occur during the withdrawal period;
the supply of alcoholic beverages, which can be delivered only after thirty days and the price of which depends on financial market fluctuations beyond the control of the entrepreneur,
delivery of goods that have been modified according to the consumer's wishes or for him,
the supply of perishable goods as well as goods that have been irretrievably mixed with other goods after delivery,
repair or maintenance carried out at a place specified by the consumer at his request; however, this does not apply in the case of subsequent performance of repairs other than those requested or delivery of spare parts other than those requested,
delivery of goods in sealed packaging that the consumer has removed from the packaging and cannot be returned for hygienic reasons,
delivery of an audio or video recording or computer program, if it has broken its original packaging,
delivery of newspapers, periodicals or magazines,
accommodation, transport, meals or leisure activities, if the entrepreneur provides these services within the specified period,
concluded on the basis of a public auction in accordance with the law governing public auctions, ordelivery of digital content, if it was not delivered on a tangible medium and was delivered with the consumer's prior express consent before the expiry of the withdrawal period and the entrepreneur informed the consumer before concluding the contract that in such a case he does not have the right to withdraw from the contract.

13. VOLUNTARY RIGHT OF RETURN OF GOODS FOR CONSUMERS
13.1 For all purchases of goods, Westwing grants you a voluntary right of return for 30 days from receipt of the goods, in addition to the statutory right of withdrawal under Section 12. This voluntary right of return gives you the option to withdraw from the purchase contract even after the 14-day withdrawal period (see section 11) by returning the goods to Westwing within 30 days of receipt.
However, the condition for exercising the voluntary right of return is the return of the complete goods in perfect condition and without damage in the original sales packaging. Otherwise, Westwing reserves the right to refuse the return. If products are returned under a voluntary right of return, the buyer bears the shipping risk. The right to voluntary return does not apply to the purchase of gift vouchers.
13.2 The refund amount will be debited from the means of payment you used to make the payment. If direct debit has been selected as the means of payment, you do not have to object to the direct debit.
13.3 Your statutory right of withdrawal (see clause 11) is not affected by compliance with the requirements set out in this clause 14 and continues to apply independently of it. Until the expiry of the statutory right of withdrawal, only the statutory conditions specified therein apply. This contractually granted (voluntary) right of withdrawal does not limit your statutory warranty rights, which remain unlimited.
14. REIMBURSEMENT OF SERVICE COSTS IN THE EVENT OF A PARTIAL REVOCATION.
If you cancel the contract for only part of the goods in the order (partial cancellation), Westwing will refund your payments for the goods affected by the cancellation, including delivery and assembly costs (if not yet assembled). However, if the costs of delivery and assembly (parts thereof) would be incurred even if you only ordered goods for which you did not cancel the contract, these costs are excluded from the refund.
15. RESERVATION OF OWNERSHIP
The goods remain the property of Westwing until the purchase price for the goods is paid in full.

22. FINAL PROVISIONS
22.1 Any disputes arising out of or in connection with the use of the www.westwing.cz Site shall be governed exclusively by Czech law, excluding conflict of law provisions. The competent court for resolving consumer disputes related to the performance of a contract is a general court with territorial and subject-matter jurisdiction according to the provisions of the law of the Czech Republic.
22.2 If any provision is or becomes invalid or ineffective, the other provisions shall remain in effect. The relevant provisions of the law shall apply in place of invalid or ineffective provisions.
